Noting that no principles of
natural justice have been violated by courts in 1993 Mumbai serial blasts
case-accused Yakub Abdul Razak Memon’s lone journey to death penalty, the
Supreme Court on Tuesday dismissed his curative petition as he inches toward his
execution scheduled on July 30. Decided away from the public eye inside
the judges' chambers at the Supreme Court, a bench of Chief Justice of India
H.L. Dattu and Justices T.S. Thakur and Anil R. Dave found no merit in the
curative petition. The order said a curative plea would have triumphed
had Memon been a victim of any of the following circumstances during
litigation. One, if he was not made a party in the lis (litigation); two,
having being made a party, he was not issued notice of the lis; and thirdly, if
the judge concerned was proved to have some prior “connection” with the case,
which might give an apprehension of bias.
